La questione della priorità tra sovranità della legge e sovranità popolare non è recente. Oggi si parla alla leggera di «populismo» ad ogni piè sospinto ma non ci si rende conto dell’origine seria e controversa di quel dilemma e delle sue implicazioni teoriche e giuridiche. Se ne può cogliere un episodio sintomatico nell’Atene del tardo V secolo ma anche nella vasta dottrina interpretativa intorno all’art. 1 della nostra Costituzione.
